1 Acceptance of Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("Customer," "you") and Box Hub ("Box Hub," "we," "us," "our"), a shipping container dealership headquartered at 228 Park Ave S, New York, NY 10003. By accessing boxhub.com (the "Site"), requesting a quote, placing an order, renting a container, or otherwise doing business with Box Hub, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site or place an order. These Terms apply in addition to any order confirmation, delivery agreement, rental agreement, or financing agreement you sign with us, which will control in the event of a direct conflict on that specific transaction.

2 Eligibility & Accounts

You must be at least 18 years old and legally able to enter into a binding contract to purchase, rent, or finance a container from Box Hub. Business customers represent that the individual placing the order has authority to bind the business.

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at help@boxhub.com of any unauthorized use.

3 Products & Condition Grading

Box Hub sells and rents New/One-Trip, Used, Cargo Worthy, Wind & Water Tight (WWT), Refrigerated (Reefer), Office, Storage, and Modified/Custom shipping containers, along with related accessories. Every container is assigned a condition grade at the time of listing based on visual and structural inspection.

• New / One-Trip: Made a single voyage from the factory; cosmetic marks only.
• Cargo Worthy (CW): Certified fit for international ocean shipping at time of grading.
• Wind & Water Tight (WWT): Not cargo-certified but fully sealed against the elements.
• Refrigerated (Reefer): Includes a refrigeration unit; functional status disclosed at sale.

Photos and descriptions are representative of the specific unit or, where inventory is pooled, representative of units in that condition grade at that depot. Minor cosmetic variation (surface rust, decals, prior markings) between listing and delivered unit is normal and does not constitute a defect.

4 Orders, Pricing & Payment

Placing an order through the Site, by phone, or by email constitutes an offer to purchase, which Box Hub may accept or decline. An order is confirmed only when you receive written order confirmation from Box Hub.

Prices are listed in U.S. Dollars and exclude delivery, applicable taxes, permits, and site-access surcharges unless stated otherwise. We reserve the right to correct pricing errors, including after an order is placed, and will notify you before processing payment if a correction is needed.

Payment is due according to the terms stated on your order confirmation (in full, deposit plus balance, or financed). Accepted payment methods, deposit requirements, and balance-due timing are disclosed at checkout or by your sales specialist.

5 Delivery & Title Transfer

Box Hub arranges delivery via tilt-bed or flatbed carrier to the address you provide. You are responsible for ensuring the delivery site is accessible, level, and legally permitted for container placement, including any required local permits or HOA approval. Additional charges may apply for difficult access, off-loading equipment (crane/forklift), or failed delivery attempts due to site conditions.

Title and risk of loss transfer to you upon delivery and off-load at the agreed site, unless otherwise stated in a financing or rental agreement. Estimated delivery windows are not guaranteed; Box Hub is not liable for delays caused by carriers, weather, permitting, or circumstances outside our reasonable control.

6 Returns, Refunds & Cancellations

Purchases are covered by our 30-Day Money-Back Guarantee, subject to the eligibility rules, deductions, and timelines described on our Returns & Refunds page, which is incorporated into these Terms by reference. In summary: unmodified containers may be returned within 30 days of delivery; custom-modified and powered-on refrigerated units are generally final sale except in cases of defect or transit damage.

Orders cancelled before delivery may be subject to a cancellation fee to cover carrier scheduling and restocking costs, which will be disclosed before your cancellation is finalized.

7 Financing

Where Box Hub offers financing, approval, rates, and terms are determined by our third-party lending partners and are subject to credit review. Financing agreements are separate contracts governed by their own terms; in the event of a conflict between a financing agreement and these Terms, the financing agreement controls for that transaction. 8 Container Rentals

Rental containers remain the property of Box Hub at all times. Rental customers are responsible for the container's condition during the rental term, ordinary wear excepted, and must return the unit by the agreed end date or renew the rental agreement. Rentals are governed by your specific rental agreement, which supplements these Terms.

9 Modified & Custom Containers

Modified and custom containers (cut doors, windows, paint, electrical, shelving, and similar work) are built to your specifications. Once fabrication begins, custom orders generally cannot be cancelled or returned except for defects in workmanship or materials. Lead times for custom work are estimates and may vary based on scope and materials availability.

10 Warranty Disclaimer

Except as expressly stated in a written warranty, condition-grade disclosure, or applicable law, containers and accessories are sold "AS IS" and "WHERE IS." Box Hub disclaims all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Nothing in this section limits any non-waivable consumer protection rights available under applicable state or federal law.

11 Limitation of Liability

To the fullest extent permitted by law, Box Hub's total liability arising out of any order or use of the Site is limited to the amount you paid for the applicable product or service. Box Hub is not liable for indirect, incidental, consequential, or special damages, including lost profits or project delays, even if advised of the possibility of such damages.

12 Website Use & Intellectual Property

All content on the Site, including text, photos, logos, and design elements, is owned by or licensed to Box Hub and may not be copied, reproduced, or used commercially without written permission. You agree not to misuse the Site, attempt unauthorized access to our systems, scrape pricing or inventory data, or submit false order information.

13 Indemnification

You agree to indemnify and hold Box Hub harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of a container, violation of these Terms, or violation of applicable law, including site-placement, zoning, or permitting requirements you are responsible for.

14 Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state or federal courts located in New York, NY, except where applicable law requires otherwise.

15 Changes to These Terms

Box Hub may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or placement of an order after changes are posted constitutes acceptance of the revised Terms.
